The state's regulator of real estate said that developers in Maharashtra will soon be required to provide more details about the amenities included in their housing projects, as well as a date by which buyers can use them.

The statement stated that residents may "be enticed" to sign a contract by the promise of a pool, gym, or community center. However, agreements often need to specify when or how these amenities and facilities will be available.

It said that a lack of clarity could lead to future disputes and unfulfilled hopes.

The regulator stated that the current 'Schedule Two" of the Model Agreement for Sale does not include any information about the features or delivery dates, but only lists the amenities and facilities.

The order stated that "the proposed order makes it mandatory for residents to provide the precise date on which they will have access to these amenities and services."

Developers will be required to provide details of the amenities, such as swimming pools, badminton, tennis, squash, societies, gymnasiums, and table tennis courts. They must also include their sizes and dates.

This information is important for all homebuyers so that it will become a mandatory clause in any agreement of sale.

The regulator has added that it is proposed to include this clause as an irrevocable clause in the Model Agreement for Sale after clauses regarding force majeure and liability periods, carpet area, transportation, and the newly added parking.

MahaRERA has posted the draft on its website. The watchdog is inviting public comments and suggestions on the draft by the 27th of May.
